INDUSTRIAL DESIGNS - ARIPO/Zimbabwe Industrial Designs

We advise on ARIPO and Zimbabwe industrial designs in respect of the following matters:

1

Freedom to operate searches

2

Status searches

3

Preparation of industrial design applications, filing and prosecution of the applications to grant of registration

4

Renewals – i.e. payment of annuity fees

5

Assignments and proprietor change recordals including changes of name, address and legal status etc.

ARIPO designable states for industrial designs

Like ARIPO patents, industrial designs in ARIPO are registered under the Harare Protocol and in relation to the same 18 designable states. However, due to variations in Member States’ laws, whether to designate all or some of the 18 designable states is a matter of strategy and shrewdness. This arises primarily from the fact that although ARIPO examines industrial design applications based on a standard of relative novelty, some ARIPO states such as Kenya and Uganda require such designs to pass specific national requirements before they become registrable in these jurisdictions.

Additionally, enforceability of ARIPO industrial design registrations in designated states is another important consideration. Strategy and shrewdness therefore necessarily inform the wisdom of getting the most expansive and effective industrial design protection possible in each case.

Requirements for filing an industrial design application in ARIPO:

1

A completed application in ARIPO’s prescribed form of application

2

Graphic representations of the design

3

Optional – we prefer to file a Distinctive Statement (Statement of Novelty) identifying the distinctive features of the design

4

Proof of payment of filing fees (application and state designation fees) or a Letter of Undertaking to pay the prescribed official fees within 21 days; and

5

A Power of Attorney that is executed on ARIPO Form 4. A simple signature of the Power of Attorney is sufficient. Legalization or notarization of the Power of Attorney is not a mandatory requirement.
